This policy explains what personal information Learning with Nicole Ltd ("we", "us", "our") collects about you, why we collect it, what we do with it and what rights you have. It sits alongside our Cookie Policy and our Learner Agreement & Terms.
Who we are
Learning with Nicole Ltd is a company registered in England and Wales, company number 15942500, at 28-30 Enterprise Road, Waterlooville, PO8 0BT, United Kingdom.
We are the data controller for the information described in this policy. If you have any question about it, email hello@learningwithnicoleltd.co.uk.
What we collect
When you apply for a course
Your name, date of birth, email address, phone number and home address; the course, study pace and payment plan you choose; and your electronic signature on the learning agreement.
We also ask a set of questions about how you learn, how much time you can give the course each week, whether you have studied part of the qualification before, what you are doing at the moment (including where you work or volunteer), and when tutor sessions would suit you. These answers are used to build your learning plan and to brief your tutor.
Information about your health or learning needs
During the application we ask whether there is anything we should know so we can support you properly — for example dyslexia, ADHD or autism, a mental health condition, or a physical health condition or disability.
This question is entirely optional, it never affects whether you are accepted, and we only store your answer if you give us your explicit consent on the form. That consent covers arranging your support and nothing else. You can withdraw it at any time by emailing us, and we will delete the answer without affecting the rest of your enrolment.
When you are studying with us
Your coursework and assessment records, tutor feedback and observation notes, attendance and progress, and correspondence between you and us.
When you pay
Our payment providers handle your card and bank details directly — we never see or store them. We keep a record of what was paid, when, by which method, and the reference our provider gives us.
When you use the website
If you agree to analytics cookies we collect information about how you use the site. Our Cookie Policy explains this in full, including how to change your mind.
While you are filling in the application form, your answers are saved in your own browser so you can close the tab and pick up where you left off. That copy stays on your device, is deleted after seven days, and can be cleared at any time using the "start fresh" link on the form.
Why we can use it
Under UK GDPR we must have a lawful basis for using your information. Ours are:
To perform our contract with you
Enrolling you, delivering and assessing your course, arranging tutor sessions, registering you with the awarding body, taking payment and issuing your certificate.
Our legitimate interests
Running and improving the service, keeping our records accurate, understanding how the website is used, and protecting against fraud and misuse. We only rely on this where it does not override your rights.
Your consent
For information about your health or learning needs, for analytics and advertising cookies, and for marketing emails where consent is required. You can withdraw consent at any time, and doing so does not affect anything done beforehand.
Legal obligation
Keeping financial records for HMRC, and meeting the record-keeping requirements set by our awarding bodies and their regulators.
Marketing emails
If you apply for a course, we may send you occasional emails about our courses and offers, because you approached us about exactly that. Every one of those emails has an unsubscribe link, and you can opt out when you apply or at any point afterwards by emailing us.
Opting out never affects emails we have to send you about your own application or course — your agreement, payment details, tutor arrangements and results.
Who we share it with
We do not sell your information. We share it only where we need to:
- Awarding bodies (NCFE CACHE, ICQ) — to register you, submit your work for moderation and issue your certificate.
- Payment providers (Stripe and GoCardless) — to take payment and manage instalments.
- Service providers who host the website, store our files and send our email, acting on our instructions only.
- Professional advisers and authorities — our accountant, or a regulator or public body where the law requires it.
Some of these providers are outside the UK. Where that happens we rely on UK adequacy regulations or standard contractual clauses to keep your information protected to the same standard.
How long we keep it
- Applications that don't proceed — up to 12 months, then deleted.
- Learner and assessment records — for as long as our awarding bodies require, so your qualification can always be verified.
- Financial records — six years after the end of the tax year, as HMRC requires.
- Health and learning-needs information — only while it is needed to support you, and deleted sooner if you ask.
Keeping it safe
Access is limited to the people who need it. Information is held in secured systems, encrypted in transit, and protected by access controls. No system is perfect, but if something did go wrong and it put your rights at risk, we would tell you and the ICO.
Your rights
You have the right to:
- ask for a copy of the information we hold about you;
- have anything inaccurate corrected;
- ask us to delete information we no longer need;
- object to, or ask us to restrict, certain uses;
- ask for your information in a portable format;
- withdraw consent where we rely on it.

Complaints
If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk, or on 0303 123 1113.
Changes to this policy
If we change how we use your information we will update this page and change the date at the top. Where the change is significant, we will tell you directly.
